September Meeting

It is disappointing that on two consecutive sittings, Council (by majority vote) resolved not to consult with precincts on the new rules and procedures before they take effect.

The motions below would enable us to continue to run precinct meetings the way we have, without being encumbered by the Code of Conduct and be inclusive of and welcome anyone interested in contributing to our precinct discussions.

Please do not hesitate to drop me an email if you have corrections or amendments to the proposed motions well before the meeting.  This will allow me to update the online version for everyone's benefit.

MOTION 1

The purpose of this motion is to obtain clarity in relation to the applicability of the code of conduct on non-executive members of the precinct committee in the light of legal advice that we have been provided with.

THAT in consideration of:

a) Statement on page 2 of Director Governance & Financial Services Report No GF23/15 dated 28th July 2015 (tabled and annotated) that reads:

"Accordingly it follows that members of Precinct Committees are bound by Council's Code of Conduct and again the Rules & Procedures have been updated to reflect this."

b) Statement on page 1 of Memorandum to Mayor and Councillors dated 24th August 2015 (tabled and annotated) that reads:

"This further advise again states that Non-Executive members of Precinct Committees are bound by the Code of Conduct ..."

c) Office of Local Government's Standards of Conduct for Council Officials (tabled and annotated) tabled at precinct meeting on 3rd August 2015 that states:

"Breaches by delegates of council committee members may result in: censure; requirement to apologise; prosecution; or removal or restriction of delegation."

PURSUANT to Resolution 37/15 of Precinct Committee dated 3rd August 2015 that reads:

"That upon consideration of OLG's Standards of Conduct for Council Officials document tabled by the Chairperson, the Precinct Committee is opposed to being bound by Council's Code of Conduct as implied by Marsdens' legal advice dated 21st May 2015."

NOTWITSTANDING Resolution 187/15 of Council dated 29th July 2015 that reads (relevantly):

"all Precinct Executives be advised that they are bound by Council's Code of Conduct moving forward and that a briefing session on how the Code of Conduct applies to be provided in the near future to all Precinct Executives"

the Precinct Committee seek express guarantee from the Office of General Manager that Council indemnifies and holds harmless all Non-Executive members of the Precinct Committee in respect of consequences arising from, or in relation to, being potentially legally bound by Council's Code of Conduct.

AMENDMENT 1

The last paragraph be revised as follows.

the Precinct Committee seek express guarantee from the Office of General Manager that Council indemnifies and holds ineffective any application whatsoever of Council's Code of Conduct to Non-executive members of the Precinct Committee or in the alternative states that the Code of Conduct does NOT apply to Non-Executive members.

AMENDMENT 2

This is an addition will cover the scenario where the Office of General Manager is unable to provide us the guarantee.

and in the event Council us unable to provide the guarantee, the Chairperson be authorised to seek such a guarantee from the Office of Local Government.

MOTION 2

The purpose of this motion is to allow us to welcome anyone to our meetings as we always have, and to seek formal leave from the Office of General Manager to exempt us from the particular clause in the amendment.

That the Precinct Committee acknowledge the amendment to Section 3 (tabled and annotated) as the Office of General Manager's response to request(s) from unnamed precinct(s), the rule:

"Residents, tenants and property owners from outside the designated Precinct are prohibited from attending."

the Precinct Committee request that the Office of General Manager grant express consent to allow anyone outside the Precinct to attend its meetings in accordance with its long established tradition of allowing anyone with an interest in the Precinct to contribute to its discussions so long as they do not disrupt or otherwise interfere with the conduct of the meeting broadly in accordance with the intent of relevant provisions of the Precinct Rules and Procedures in effect.
