The La Perouse Precinct at its meeting yesterday attended by the General Manager, Precinct Coordinator, and Crs Danny Said, Noel D'Souza and Carlos Da Rocha, failed to resolve on its submission to IPART that is due in 6 days, on Tuesday 13th March 2018.

Publication of Minutes

La Perouse Precinct position on Publication of Precinct Minutes

We acknowledge Council's Precinct Rules and Procedures [22/09/2015]:

  • Section 4 requires that we hold public meetings once a month.
  • Section 9 states that our minutes are a public record of a community meeting.
  • Section 6 requires that we publish minutes and associated documents to residents.
  • Section 6 states that Council will assist by publishing our minutes on its website.

We acknowledge Randwick City Council position [06/11/2015]:

  • Executives are required to send minutes to precinct residents.
  • Executives may publish precinct minutes on their own websites.

We acknowledge Office of Local Government position [22/10/2015] [18/11/2015]:

  • The requirement that councils publish precinct minutes on their website is arguable.
  • Councils are entitled to refuse to publish minutes on the basis of content and/or format.
  • It is reasonable for Randwick City Council not to publish our minutes based on content.

On the basis of the information available to us, it is our position that we are required to publish our minutes and that it is appropriate for us to do so using the precinct website.

It is also our position and understanding that considering the Precinct Rules and Procedures require us to publish our minutes, Council will hold us harmless in respect of consequences arising from or in relation to such publication.
